Library The software module named 'mtdcoder' ('libmtdcoder'), used to control the protection keys (hardware devices) from an operating system level. Product So called 'Work In Progress' or a 'Final Software Package', using any of internals provided by the Library. The linking method used does not matter (static, shared), all solutions apply. Licensor The author and owner of the Library (TinyIT). Licensee Software vendor, an individual or a company who connects the Library with at least one of owned Products. User An individual or a company who is in possession of the Product and is using it in own works (so-called 'End User' or 'Final User'). License Electronic or paper version of this document, giving/confirming some rights to its legal holder. PK-s Protection keys, hardware devices functionally dependent from the Library. Statements. 1. Possessing a signed copy of this document is a proof of purchase. 2. Basic release of the mtdcoder library is shipped in binary form only, free of charge, as part of the software package with bought PK-s. The PK-s buyer or a designated entity, who make this Library a part of own Product, becomes the Licensee, automatically falls under this License and must agree to all further statements. Otherwise, entire software package and the protection keys should be sent back to the Licensor for a refund. 3. The License is issued for a single individual Licensee, for use in the development phase and distribution, as integral part of the Product. Licensee is granted a non-exclusive right to include this software in binary form, into any software project developed and distributed, for unlimited period of time. Entire or any part of the library may not be redistributed in any way, separately from the Product. 4. There is no dual licensing for a single/multiple user, seats, computers or number of processors used. For development and testing, the Licensee may copy it on any number of storage devices he or she is the legal owner of. 5. Disassembling and reverse engineering any part of the software, for further use in own works is not allowed and might result in civil prosecution. This applies not just to the Library but also the PK, firmware, drivers and other tools included. 6. The software package is under constant development and errors might arise. The Licensor obligates himself to remove any inoperative parts of code as soon as possible and if possible, after receiving an issue report. The Licensee has a right to download updates from the project's website and use the updated software on the terms of this license. Though tests are made before each release, the Licensee is using the software at own risk. 7. Neither the author nor the agents of the author will be liable for data loss, damages, loss of profits or any other kind of loss while using or misusing this software. The Licensee and Users of the Product are responsible for any kind of backup copies needed to keep the final Product function properly. 8. The free of charge, technical support is served for three months after the date of purchase of PK-s. Over that time the Licensee can contact with the Licensor, if issues arise. Technical support subscription can be renewed on monthly bases. Project's website tells the details. 9. The Library might not be transferred by itself. It would stay in conflict with points 2, 3 and 10. Transfer is still possible in its entirety, in cases when the Licensee decides to give away the Product, including source code, documentation, etc. to the third party, making that entity responsible for further Product development. In that particular cases, following conditions need to be met: - the third party receiving it agrees to the terms of this License, - the third party receives from Licensee free of charge, all rights to the Library and accompanying materials, as obtained from the Licensor, this includes software binaries, documentation, header files and examples, - the Licensee can re-sell the PK-s as part of the Product, to the third party but the price may not be much higher than payed to the Licensor - it should be a 'non-profit' resale. 10. The Licensee is prohibited to rent, lease, re-sell the Library, or any subset of it, exact as provided earlier in this agreement. Any such unauthorized actions shall result in immediate and automatic termination of this License and might also result in criminal and/or civil prosecution. 11. All rights to the library and the software package it is being released in, not mentioned in this License are exclusively owned by the Licensor.
